Responds to ISP's legal challenge of the FCC's decision ordering it stop throttling BitTorrent.

FCC Chairman Kevin Martin has released a statement in response to the recent news that Comcast has formally filed an appeal with the US Court of Appeals for the District of Columbia Circuit asking it to reverse a recent FCC ruling that ordered an end to "interference with connections of P2P applications."

"Given Comcast's past failure to disclose its network management practices to its customers, it is important Comcast respond to the many still-unanswered questions about its new management techniques," he said. "In particular, what exactly does it mean by a 'protocol agnostic' management technique?"

In particular , Martin wants answerers as to how Comcast intends to manage network bandwidth congestion in the future.

"Will there be bandwidth limits and, if so, what will they be?" Martin asked. "Will they be hourly? Monthly? How will consumers know if they are close to a limit? If a consumer exceeds a limit, is his traffic slowed? Is it terminated? Is his service turned off?"

Comcast has already announced plans to institute a 250GB data cap starting Oct 1st.
