‘Free Jammie’ – Mother Who Lost to the RIAA Seeks Help

Trust fund created by her attorney will be used to for legal expenses, and for a PENDING APPEAL of her case which may ultimately go to the Supreme Court.

Last week was a sad day for the file-sharing community with a win by the RIAA against Jammie Thomas, the first accused file-sharer to ever have their day in court before a real live judge and jury.

The Jury ordered Thomas to pay some $9,250 for each of the 24 songs she was accused of illegally sharing on the KaZaA file-sharing network. This amounts to some $222,000 in total penalties, a figure sure to cause headaches until she appeals her case.

Well now a trust account has been set up in her name by her attorney Brian Toder to help her out in this great time of need.

All the funds collected at FreeJammie.com are to be used for legal expenses, and for a PENDING APPEAL which may ultimately go to the Supreme Court.

The site reads:

Donate to Jammie. Don’t let the big record companies get away with this corporate bullying and intimidation! Let’s help Jammie stand up to them!
Having tried the case and thereby set the stage for an appeal that, if successful, has the potential to stop the RIAA’s harvesting machine dead in its tracks, a legal defense fund has been created, and we need your help. All funds will be deposited in a client trust account at the offices of Jammie’s counsel.
Your paypal donation to Jammie Thomas can send a message to the recording industry: the public isn’t afraid of their strong arm tactics. We can stand together and help Jammie fight the big record companies. Let’s show the big record companies whose side we’re on!

She also has clip up on YouTube appealing for the public’s help.

It appears that she has about $3,800USD collected so far, but hopefully the amount will rise quickly before her case is heard on appeal.

Even if you can only chip in a few bucks or so it’s better than nothing at all. The case has huge repercussions for us all so its important that we help Thomas do all she can to win.

    She’s been fined an inordinate amout of money. A years salary. BUT I have to ask if you’re appealing surely the judge will change the fine? We aren’t really going to pay that fine for her are we? If this must be paid then I will donate but why do you fine people huge sums they can’t afford?

    she was freaking stupid. she got busted and could have paid a few grand to make it go away. instead she was stupid and listened to an idiotic lawyer and lost big. let her figure out where to get 220000 bucks on her own.

    whats bothering me is that its her lawyer that set up the fund and not her. its like not only did he fail miserably he wants us to help pay him to lose again.

    Well she’s certainly retarded for using KaZaA that alone is worthy of a $220000 fine IMHO but considering she had the balls(metaphorically speaking) to take the RIAA to court for the FIRST TIME EVER rather than settle like everybody else she’s definitely going to get a few bucks from me.

    Well the reason they lost apparently is because the judge set it up so they would and thats why so many people are confident she will win on appeal.

The laws are whats fucked up. There is not much you can do but someone needed to stand up for the public to realize how screwed the new laws are. The RIAA doesnt need proof she doesnt have to upload anything either. If you have files on your PC that are in a foilder that can be accessed on the internet you too can be sued and thats without ever uploading anything!!!!

    Calm down! They didn’t say anything that was not true! She SHOULD go get another lawyer…preferably one recommended by the EFF. And she SHOULD make a different argument other than a flimsy “I was hacked” excuse!

    If she would have had decent counsel and they had argued what RAY BECKERMAN said to argue….about the “making available” theory….they could have won this case.

    But having bad counsel and a stupid argument is going to get you CONVICTED every time. And your rant about p2p people can include YOU so watch what you say.

    though i agree with much of your rant mels (i dont suck cock dude) what i *have* read of the case has pissed me off. even i know the argument was bullshit and you cant bullshit the bullshitter on something like this. now soul saying something to the extent that she deserves to pay the sum of the value of a pretty nice house is lame so i can see why you are pissed. personally i WANT to help but im not going to bother if i dont feel that theres a snowball’s chance in hell to win with the current circumstances. i dont know that lawyer’s qualifications but judging by the snippits of the case i read he has to go. there is no way a good copyright lawyer would argue (or fail to do so) like that.

    This was hard to accept at first she is where she is though. And fingers crossed for the appeal. I expect this money to be returned if the fine amount is changed. OK the Paypal link is not working from the cached site. (And Jammie don’t go inviting the internet around your house they urinate on the floors leaving you to foot the bill.)

    But I do agree with him that there is nothing wrong for standing up for what you believe in….but MY point is…. DON’T BE A DUMBASS ABOUT IT!

    At least have the common sense to make a decent argument and have a good lawyer to do it ……otherwise you are just painting a bullseye on your chest for the likes of the RIAA.

    Ya takes the lawyers ya can find. That lawyer was the only lawyer in the state that was listed in the http://recordingindustryvspeople.blogspot.com/ lawyer directory. Any given case is a crapshoot. A bad judge you’re dead. A bad jury you’re dead. Stuck in a situation where you can’t make any convincing arguments you’re dead. A bad lawyer you’re dead. I don’t know which situation prevailed here though from one juror’s comments it appears that it’s a really bad idea to use a file sharing nick that’s the same as any of your other nicks. And remember in a “civil” case they don’t have to prove anything beyond a shadow of a doubt all the jury has to decide is that it’s 51% against you.

    The problem wasn’t her lawyer apparently but in how the judge instructed the jury to try the case.

    I HOPE that Ray Beckerman is right and this case still has a chance of being won….because the implications for file sharing are really on the line here.

    If they lose on appeal….then that will only embolden the RIAA even more…which is NOT what file sharers need!

    By the way I was born in 63….so yeahI am an old fart! And yeah I do remember barretta and welcome back kotter when they were on broadcast TV in the 70s.
