MediaDefender memo lists sites from “strong to low presence.”
NOTE: In light of the recent leak of some internal MediaDefender memos have been able to reprint this e-mail and story concerning it in its entirety.
Many of you I’m sure are now familiar with MediaDefender, a self-described “leading provider of anti-piracy solutions in the emerging Internet-Piracy-Prevention (IPP) industry,” and how they are frequently employed by movie studios and record labels to make illegal file-sharing as difficult as possible.
The infamous 99.9% BitTorrent tracker download on TorrentSpy is perhaps the most famous of all fake files that I’m sure they can take partial credit for.
A number of fake Korn albums is apparently some of their most recent work in support of one of their clients, EMI Records.
But, it’s often wondered to what degree MediaDefender monitors a BitTorrent tracker site and works to protect the copyrighted material of a particular client.
Well, I have been fortunate enough to get a hold of an interesting internal MediaDefender e-mail that details the degree of BitTorrent tracker site protection they offer for one of their clients, which in this case is Fox Studios.
It reads:
UPDATE: We have been served with a “C&D” letter from the law firm Sheppard Mullin, which ironically I hear use to represent Zeropaid in the past.
Apparently the “…use, display, and/or misappropriation of MediaDefender’s trade secrets and confidential information” is a big “no can do.” Who would’ve thought that exposing the under-handed tactics of an anti-P2P company would bear such legal repercussions (Don’t all raise your hands at once).
Pretty straightforward legal stuff right? Well, in case you haven’t had a chance to read the e-mail, I was lucky enough to find that a copy of it had been uploaded by a loyal reader to the Pirate Bay’s image hosting service, BayIMG.

I think what’s most interesting to find in this list is the fact that the Pirate Bay and Mininova are at the bottom with a “low presence” of anti-piracy activities. There could be a number of reasons for this but, I think it’s because the pair are just too darn sophisticated to fall for the fairly easy to detect and predict IP addresses that MediaDefender uses to upload fake content.
Also to note is the glaring lack of PRIVATE tracker sites on the list. Very interesting to say the least.
Either way, at least the list can provide you with a better idea of what sites to avoid if you don’t want to have a run in with fake content, or worse yet, have your IP captured for legal action by the a client’s copyright attorneys.

thanks for the story soul. i havent had the chance to download the emails myself but its good to hear the highlights. im happy to see the 3 public sites i use the most are the least targeted.
Careful. Could be a trick to get more people to use the ones at the bottom of the list which are probably really at the top! Think about it: would a company in Media Defender’s business actually let their e-mails find their way to public display? Highly unlikely. I think it’s a set-up. They let it leak on purpose.

Intricate conspiracies are a lot more entertaining than simple acts of incompetence.
There are a few good tips in the e-mails to help avoid fakes by avoiding certain web in favour of others. newtorrents.info and spynova.net are both sites to use. Newtorrents.info has always been a favourite of mine and is worth looking into.
It is unlikely that PirateBay avoid the fakes by looking at IP addresses. According to the e-mails MediaDefender know that people know their IP addresses so upload valid torrents using them. This automatically gets valid hashes banned from websites. They use proxies to upload invalid torrents.
Finally thepiratebay and mininova may have come up well in this e-mail but in most e-mails MD report a high success rate at those sites.

It pretty much shows you that any gnutella client and public bt site will get you a mix of porn into a movie a wrong movie non working file a cease and desist letter. REMEMBER A private site exposed this to us. As the stupid guy at media defender used the same password for his handle on the site and gmail account. Their attempts to any private site was a failure. As they couldnt get as many IP’s onto one handle or join the swarm with any success. Media defender never did me any harm but i hate them anyways =)
Now I know I do things “Against the grain” alot of the time BUT I am involved in Entertainment and deal with Legal Issues alot.. I would IGNORE a C&D letter and make MD prove the information posted was indeed REAL then wait for a Court Order telling me to remove something. Knowing how dirty these people and the Illegal Actions they take I would not be shocked at all if the “Leaked” files came from MD.
As for the C&D letter goes its more of a warning and since they base the claim on “trade secrets” its NOT covered under DMCA and any provider that would “Take Down” the content would itself be in violation of a Federal Law. OH YES I have ignored many C&D letters and yet to have legal action taken against me.

I was hit by my ISP’s throttling and could not download movies and tv episodes via azureus. after tweaking my system according to the “extreme bittorrent” guide and using their recommended softwares my speed suddenly jumped from 60-70k to 3mbps! now i can watch movies online and also download via utorrent. in fact now-a-days i prefer downloading from torrents because the speed is simply great and i don’t have to wait for more than 15-25 minutes for a 700 mb movie. trust me once you read this quick guide nothing will be the same again.

The obvious solution is to mention that the email(s) in question has indeed been forwarded to the FBI’s cybercrimes unit for further investigation. Throw in a mention of the attack against Revision3 somewhere in there and see how quick they back down.
