Sweden’s Justice Ministry Wants ISPs to Reveal Illegal File-Sharers

Proposes legislation that would enable copyright holders to find out the identity of those suspected of illegal P2P file-sharing.

Determined to stamp out piracy in their country and placate the long-simmering anger of copyright holders and their lobbying groups around the globe, Sweden’s Justice Ministry proposed legislation today that would for the first time allow copyright holders to to seek assistance from the court in demanding that ISPs reveal the identities of those they suspect of illegal file-sharing.

Under the proposed regulations, courts would be able to force ISPs to hand over the names of people suspected of having violated intellectual property laws to those copyright holders who apply.

“Thereby, it will become easier to intervene against illegal file-sharing, which in turn will stimulate the development of legal alternatives for distribution of, for example, film and music over the Internet,” the ministry said in a statement.

In a rebuttal to the effort Tobias Andersson, a Piratbyran spokesman, criticized the move, calling it “…completely crazy” and noted “…that it is time to stop pampering the record industry.”

“The danger here is that it will speed up the development of anonymous file-sharing programmes that make it technically more difficult to trace somebody’s internet use. These kinds of services can also be exploited by people involved in criminal activities, such as paedophiles,” Andersson also noted.

According to a ministry spokesman, the legislation is an attempt to bring Swedish intellectual property laws into line with a 2004 European Union directive.

But, considering that this news follows on the heels of last weeks failed efforts by Swedish law enforcement to get ISPs to block access to the Pirate Bay using unsubstantiated claims of child pornography, this latest action looks all the more dubious and seemingly the result of larger forces at work.
