I'm thinking that what they are getting at really is the whole concept of the three strikes law which is a huge issue in the UK right now.

If there was actual justice involved in the three strikes law, then each strike would be a court case. Since three strikes isn't the same thing as a lawsuit as seen in the US, then yes, every copyright infringement case would be on a per file basis (as we are talking one act, one strike)

Since that is unattainable through justice as it would send the court system straight into bankruptcy, then the only option is to skip the court system entirely (which I discussed in the article)

If you think it'll just be a collection of files that counts as a strike, there have been cases in New Zealand where one act meant one strike - I believe that had something to do with voice-acting over public domain material of all things. So yes, not only is it an actual fact that three strikes is a per-file issue, but it was even practiced that way already.

I would argue that the PPUK aren't entirely out in left field on this as you have argued. Lawsuits and three strikes schemes are two different beasts.

Have to agree with you there, they should have more integrity if they want to gain support from the mass electorate. Stunts like these will just turn people off.

It's unlikely they would hold a trial for each file a person is accused of sharing. More than likely they would hold one trial or one trial for each copyright holder affected (although a judge would likely combine the suits where possible) and establish if and what files were illegally shared and assign punishment accordingly. While the hundred files may effect the severity of the punishment the impact on the number of cases is no where near as severe as the trial per file suggested the Pirate Party. This is almost as bad as the BSA making up piracy statistics.

I support what the Pirate Party wants to do, but that's no excuse for bogus stats and exaggerations.
