Attorneys from the Pennsylvania law firm Feldman & Rifkin and the California law firm Kaplan, Fox & Kilsheimer are collecting complaints from angry music fans who believe the music CDs they bought are copy-protected without adequate labeling. Both firms say that they are likely to file a suit against the record industry for ‘deceptive trade practices’ and ‘breaking labeling laws’.
A similar suit by Californian Karen DeLise, who sued the copy-protection firm SunnComm has ended in victory for Karen DeLise. As part of the settlement, Music City Records and Fahrenheit Entertainment will provide a more detailed disclosure on CD packaging.
The RIAA claims that only 2 copy-protected CD’s have been released in the USA. This is likely to be only referring to CD’s that have gone full-release with copy protection. FatChucks have a list of a lot more than 2 CD’s that have in built copy protection. Read the full story here
