TVUPlayer, that wonderful little creation by Paul Shen, the CEO of TVU Networks, is facing a lot of criticism these day from major TV networks and others who insist it violates current copyright laws.
Unlike YouTube, which legal experts argue is protected under the safe harbor provision of the Digital Millennium Copyright Act, TVU Networks has a difficult time arguing that it doesn’t engage in copyright infringement. As John Stickevers, a Boston copyright attorney notes, “The safe harbor provision doesn’t apply if the service provider has actual knowledge of the infringing activity on the system.”
But Shen argues that it is the users of his P2P TV streaming technology who are responsible for any copyright violations and not him, “…they are the ones who stream the TV broadcasts.”
This is the old argument that many other P2P software companies tried to use before him, ala Napster, KaZaA, Grokster, Morpheus, the list goes on and on. Yet, in all cases they were still found guilty of copyright infringement because of the way that they facilitated and “actively encouraged” such practices.
Shen says that TVUPlayer was intended to do nothing more than showcase his P2P TV streaming technology. He argues that his technology can save TV networks money in distribution costs because they won’t have to “…continuously transmit content to each individual viewer.” They can also target specific users with advertising by embedding it into the video for broadcast to regions and demographic groups of the advertisers choosing.
With the much anticipated release of the Venice Project approaching, P2P TV may eventually do for television what file-sharing did for music and movies. It will allow users the beauty of choice and lower costs, in essence again doing an industry’s work for them. It seems to be the only way that many of these companies progress in technology is when they are dragged kicking and screaming by others. Either way, TVUPlayer is here to stay.
