A federal judge on Monday set an Oct. 1 trial date in a copyright infringement case against three swapping services, marking the first time a jury trial has been set in a file-trading case.
Judge Stephen Wilson denied a motion for dismissal by Streamcast Networks, Kazaa BV and Grokster. He also denied a motion for summary judgment made by the music, movie and publishing industries.
The moves were significant in setting the stage for this case to reach a jury before the Napster case, which has been jockeying around in Judge Marilyn Hall Patel’s courtroom in pre-trial motions since December 1999.
