A lawyer specializing in international intellectual property issue believes Apple will prevail against efforts to open its music content to devices other than the iPod.
Richard Neff, of the Los Angeles firm Greenberg Glusker, said that Apple has a few things in its favor as policymakers in France, the United Kingdom and now Scandinavia. Piracy may be one of them.
Neff said that in order for Apple to lose antitrust battles abroad, it would have to be abusing its position as the dominant player in music distribution. Though iPods have emerged as a favorite mobile music device, Neff said there is still an argument against their dominance.
“I don’t see in this market, which is in complete state of flux, with piracy probably as high as legitimate sales, I can’t see how Apple can be considered to have the dominant position,” he said. “It depends on how you define the market.”
