You may have read that the on-going Napster court case has been prosponed till February 17 to allow both sides to reach an agreement. However what just happened before the postponement has just been released. The transcripts of the case reveal that the judge Patel questioned if the record companies copyright extended to digital distribution of music, and granted Napster leave to explore whether the labels were colluding to prevent it licensing music for online distribution.

However it looks like Napster is only intent on meekly securing a licensing deal so is unlikely to take this golden opportunity to challange the record companies. The full story is here.
