Stifling innovations; Patents & Grokster

An often heard cry by Tech activist against legislation and court rulings in the US and EU: it’s stifling innovations! Since the DMCA, Induce Act, EU Software Patents Directive and Grokster case, this argument has been used with mixed success. Now, the ‘Industry’ is using this same argument too. But, who’s right?
