Is Spyware illegal?
No. But privacy minded people could have a strong opinion about software being installed to track web usage on their home computers. Spyware in theory capable of delivering more than just banners and web page statistics to advertisers, the reason why so many people feel uncomfortable with the idea of software tracking their computer usage.

Spyware for the most part has been given a bad name due to software developers looking to earn profits from their software without charging users to run the software.
