As expected, today saw the RIAA and MPAA file for a summary judgement in the ‘FastTrack Case’. Some details of the requested summary judgement have now emerged. The RIAA and MPAA claim to have conducted 6 months of investigation into FastTrack which prove that they knowingly contributed to copyright infringement . They believe that the evidence is strong enough for an immediate end to happen in the case. It seems that StreamCast filled their summary judgement request yesterday without making the documents open so in response the RIAA and MPAA also filled their evidence as confidential. However, some of the content of the documents may emerge over the next few days.
The Attempt to get a summary judgement in the FastTrack case is seen as a last ditch effort by the trade groups to get an end to the case before a full trial with a jury starts on October 1.
Updated: The RIAA have now run a story on this with this interesting comment:
Also included in the filing is the testimony of several expert witnesses, including Leonard Kleinrock, widely regarded as one of the original founders of the Internet. Kleinrock describes how the defendant’s file sharing system works and how they could easily control and prevent the massive copyright infringement from occurring.
