Mp3board vs RIAA: Case Closer to Trial

The RIAA have been involved in long running litigation against Mp3board.com. It is a gnutella based MP3 search engine. The case has now moved a step closer to trial with U.S. District Judge Sidney H. Stein of the Southern District of New York rejected summary judgment bids from the major music labels and MP3Board. The case is important because it examines whether linking to material that may be pirated is a violation of copyright law. Read more here

This lawsuit is one of several Lawsuits that the RIAA are involved in against mp3 websites and p2p applications. A preliminary injunction is due soon in the Madster case while the FastTrack case reaches full trial on October 1. The lawsuit against Napster is expected to reach an official conclusion on Tuesday with an expected ending to the bankruptcy case.
