The Wall Street Journal today reported on a break from the RIAA's ineffective strategy of suing filesharers (35K since 2003 according to the WSJ have been legally pursued).
This is a surprising development in filesharing...Instead, the Recording Industry Association of America said it plans to try an approach that relies on the cooperation of Internet-service providers. The trade group said it has hashed out preliminary agreements with major ISPs under which it will send an email to the provider when it finds a provider's customers making music available online for others to take.

the global economic crisis has hit everyone. you just can't afford to splurge on lawyers like you used to anymore...
They didnt expect so many people to fight it, they thought people would just send in money to settle the suit. After all, economy is in decline, who can afford a 12 dollar cd with 10 songs on it. 35 thousand in 5 years.. And their are millions if not a billion globaly that are sharing music.. At least millions and millions of songs a day are downloaded. They didnt impact more then 35 thousand.
Lets don't start sucking each other off just yet. I am sure they have something up their sleeves. However... I do not think the ISP's will want to cut their customers off, at a time like this, by adopting the "three strikes" rule. Too many people are already cutting their services because of the economy. Like I cut off my cable TV channels to save over $100 a month.
I bet they will pressure the government to pursue some of the websites that promote links to illegal files and such. I am sure they would rather spend tax dollars instead of their own $ and the law dogs would like to keep a job... so if they can make it seem like they have people to pursue while simultaneously making it seem like they are protecting the economic well being of America then that is what they will do.

In the six years of downloading ten thousand plus files. I have had no problems with my ISP. I started with KAZZA then went to Bit Tornado where I still am today.
And Mel you are not parinoid. they are not going to give up a cash cow unless they had something bigger in mnd.
I may soon have business to conduct using the net so I need the service but before the only real reason I paid the big buck$ for the best connection Charter provides is because of file sharing. I rarely use the full balls out speed I pay for but its nice to be able to upload files to people really quick. I may have to rethink that generosity for the time being and downgrade to the cheapo package to save me some $$$.
The ISP's will lose many customers by fucking with them over sharing files because that is all the fast packages are good for. Who would pay for 16Mbps only to check their Email or watch youtube? Even video gaming requires FAR less bandwidth than that... unless running a server.

This is down to the fall out between media defender and the RIAA and MPAA - media defenders tactics have been challenged in court and revealed as suspect a logged IP is a router not a computer 9/10 these days.. media defender have been dropped hence the switch in tactic- interestingly the adult industry are now using media defenders services - probably youll pay up rather than going to court for downloading "donkeys screw midgets III"
Heres my prediction- like Mels, more and more of us will be hit with "fair usage", throttled speeds or capped download on cheaper plans untill its economically unviable to fileshare- thats not a snipe at you Mels, we all are feeling the pinch
You have to have deep pockets these days to run a tracker, or even maintain a decent up speed- economics will out, many will drop their speeds and up lines to save $/£ whatever and the swarms will choke- Im already seeing it on public trackers
This is what I see happening too. I wonder if they will lean on ISP's to either throttle bandwidth to the point where it's not worth sharing files, or lean on them and make them put a line in the contract you sign with them where if they see you sharing files they will make your connection so expensive that nobody can afford it. No matter what they do though, I don't think I'm going to like it.
