I find it pretty odd that WinMX hasn't been hit with legal action yet since it seems to be growing in popularity.
WinMx would be to hard to hit because it uses a decentralized server.
There is no central location through which the MP3 files are shared,
making it virtually impossible to stop the trading on decentralized servers.
Is it possible for the **AAs to pull of a DMCA and forbid all websites from linking to the WinMX program? I know the programmers aren't responsible for what people do with their stuff but can they be found liable anyway?

Being north of the US reign of legal power could be the saving grace for this program. If you look at the legal agreement many things are spelled out very clearly. So get on this network and trade homework files.....:fire

Actually, WinMX is just a client for a broader protocol called OpenNap that anyone can use to run Napster servers with :D

It has not been sued because the RIAA don't tend to sue things they can't control. Plus the fact that it is outside the USA helps. I wonder if the canadian version of the RIAA have contacted them.
I wouldn't be surprised if the **AAs lobby Congress for economic sanctions on Canada until they pass the DMCA there.

Since its inception almost 30 years ago, the internet has been transformed from a primitive device for sharing thoughts and ideas, into a massive network where people pay to connect and read advertisements they don't want, while calling each other "asshats".
Unfortunately the WinMX network is very vulnerable to being shutdown.
Because the peer cache is on servers operated by Frontcode and whose IP address is hardcoded into the Winmx application. If Frontcode was ordered to shutdown the Winmx peer cache servers, the Winmx network would die.
Other P2P's like LimeWire have a better defence against shutdown by allowing users to edit the settings and input another peer cache (operated by a 3rd party) in case LimeWire's official one is offline.
I think Winmx would be much better protected if it used this approach. Otherwise, the only possible way to input a different peer cache (and keep the network going in a shutdown) is for someone to hack the WinMX client .
I wonder if for now WinMX wants to keep control over things because they are not in threat of being shutdown, but I hope they have a "plan B" quick software upgrade ready, that they could pass out if it looked like a court might shut them down.
Oh well, if we can't dl mp's.. we might have to put them in a zip file, and trade like that.
