Canadian MP wants to clean up the internet

The Clean Internet Act (Bill C-427) is a newly submitted private member bill in the Parliament of Canada by Conservative MP Joy Smith, that among many things will mandate that ISPs obtain a license in order to offer internet services as well as require them to DENY internet service to anyone who violates any of the Act's stipulations.

The bill isn't a big problem. As a private member bill the odds of getting through this minority parliamanet are slim to none.

To add to that, the bill has three tangent ideas that have to be considered.

1. It carries vague wording and that will be destroyed in court. Specifically I'm referring to ss. 8.3 and 8.4. It says that nobody is to contact someone under 18 to get involved with an offense. No problem, the offenses are listed in ss. 6-8 and only involve child porn, violence towards women or inciting hatred.

i.e. contacting that 14 year old down the block for cheap sex is still a-ok. It's not a criminal code offense. Contacting someone under the age of 18 for a non-offense is fine.

2. The vast onus of the bill is on ISP's and they have been ruled repeatedly to not require constant monitoring of their material. Only if the material is brought to their attention must they act.

3. For child porn offenses at least, being barred from accessing a computer for a given time is standard. This bill just puts to law the principles that have been followed by judges during sentencing for years.

The real problem with this bill is that it is completely unnecessary. All of those provisions are covered by the criminal code. This is a backbencher trying to make a name for themselves by demanding the country take notice she isn't in favor of eating aborted babies.
