The iPod is a well-established household name, though Apple has recently taken steps to minimize similar branding plays. The company sent a cease-and-desist letter to Mach5Products, maker of the "Profit Pod," alleging that branding similarities comprise a trademark violation. The Mach5 product counts transactions on arcade game machines, including the number of tokens entered, and sends the information to a central laptop or PDA. While that is a far cry from an iPod nano, Apple pointed to some product similarities, noting that both devices are "small, flat, round corned rectangular device with a display screen."
Another company facing the ire of Apple is TightPod, a maker of laptop-protecting covers. Like Mach5, TightPod applied for a trademark related to its brand, and that drew an Apple warning letter. In response, TightPod has allegedly offered to eliminate any reference to portable MP3 players, or failing that solution, has requested that Apple pay half the charges related to a name change. At this juncture, it remains unclear if either company will mount a legal defense against Apple, or if any legal action will happen.
