CBS Radio Inc. Files Suit Against Howard Stern and Related Parties

The lawsuit is for compensatory and punitive damages for multiple breaches of contract, fraud, unjust enrichment, and misappropriation of CBS Radio's broadcast time.

 

It further seeks damages from Sirius Satellite Radio, Inc. for unfair competition and tortious interference with Stern's CBS contract. The suit further charges that Sirius intentionally interfered with and procured Stern's breach of the Agreement.

 

Sirius knew that Stern had a contractual obligation to maximize the prospects for the success of the CBS Radio program and to comply with his duty of good faith. Sirius intentionally induced and caused Stern to breach these contractual provisions by offering to accelerate Stern's payment of millions of dollars in stock options to promote Sirius on CBS airwaves and by concealing Stern's stock interest from CBS Radio.

NEW YORK (Reuters) - Ribald U.S. radio host Howard Stern said on Tuesday CBS chief Les Moonves is pursuing a personal vendetta against him because the network's radio fortunes have plunged since he left to join satellite radio.

In a preemptive strike against an expected lawsuit from his former employer, Stern said CBS Corp had sent him letters saying he struck a secret deal with Sirius Satellite Radio Inc., used CBS air time to promote Sirius and hurt CBS financially.

CBS declined immediate comment on the potential lawsuit.

"I'm offended. I really do think this is a personal vendetta. Les has had it in for me for a long time. I don't deserve it," Stern told a news conference.

CBS wouldn't let Stern do his show the way he wanted to. They refused to stand up to the FCC which insisted that Stern stop saying those dirty words and submit to "community standards." Well, it seems that the "community" followed Stern to Sirius, and now CBS is pissed. Well, consider this: how many people started to listen to Sern BECAUSE of the controversy? The ratings for those shows in the last year or so on CBS sky-rocketed. You got some non-deserved revenue there, CBS, so shut the fuck up!
