why do upload speed caps off at 40kB/s?

I did a test while I was running 3 torrents...

10kB/s UP
225kB/s DOWN

My UP speeds on Azureus seems to float around 40kB/s. I'm curious as to why.

My isp caps BitTorrent uploads at about 40K/sec even though my max for other kinds of uploads is close to 100K.

i am not capped when using bittorent or any p2p program
sometimes if their is to much congestion i do drop a bit download but upload is always good
no saturation

Well if download speeds correspond to upload speeds, then this sucks.

Thats your max upload speed regardless.. Just cause you download fast, doesnt mean you can upload as fast.
My upload is 512 which is about 51kbs upstream. Sometimes you cant upload the full capacity since your sending data back to the torrents you downloaded telling them which piece to send and how much data your sending out.
