    The eMule project team have come forward to appeal the public help them to fight a legal action by a bloody company that steals and uses eMule trademark for their own gain... Worse still that company has gone and registered that trademark as theirs!!

    Well I must say it was a good business strategy, although it was an un-ethical one. The point is - the organization with the best (most expensive) lawyers always win.

    wow, now they know how movie studios and recording industry feel about their stuff being shared to millions of users. . FREE enterprise, whats more needs to be said.

    A short introduction to eMule
    In May 2002 eMule was born as a new project by someone known as Merkur. His goal was to develop a new client for the eDonkey2000 network, one which has to be distinctly different from what was known til then: user friendly, free, open source, efficient and with a nice design. Soon after the start more coders started to join the project forming a team caring for a stable network and continuously improving eMule. Today over 2 million users and a steadily growing numbers give testimony for this.

    The threat
    eMule's popularity has drawn the attention of greedy people trying to gain profit from its well-known name. Using every shady opportunity, the first dialers trying to rip off unsuspecting users already appeared early in 2003. Promising new versions or tools for eMule their only intention was to lure people in downloading their software and having them to pay for a faked service or one already offered for free. Firstway Medien GmbH plays a major role in this. Their dialer application called "Masterconnector" has been advertised on the web site eselfilme.de/org/com/net for a very long time under various disguises. Currently these pages are offering an eMule mod, which corrupts parts of Window's winsock forcing the user to pay money for a "license" or to live with a crippled and irremovable eMule mod.


    Current situation
    On the first January 2004 Firstway Medien GmbH represented by Frhr. von Gravenreuth & Bernhard Syndikus moved to attack. They started off with one of the biggest German eMule sites, eMule.de by threatening them with an injunction and demanding that they stop using their domain name. As virtually all web pages using the name eMule are now in danger of the same fate, the eMule-project.net team decided to work together with the owners of eMule.de to defy Firstway Medien GmbH and to delete the eMule trademark. Now that they have shown their true intentions, an expensive legal confrontation is inevitable. Hoping to get the necessary financial resources to win this fight we created this page to keep you informed about the progress.

    They should fight this as long as they think there is a case to fight. Names don't mean much, but things like this need to be halted in their tracks.

    This is far more than a name issue.. it's about rights.
