elby CloneCD no longer legal to sell

I wanted to check for updates to my favorite burning software, Clonecd, and I got this message from their website
New copyright law drives out CloneCD sheep

Due to the new legal situation we will stop the sales of CloneCD

We would like to take the opportunity to thank our customers for the long loyalty to CloneCD!
We hope that you will also be excited about our future products and remain with the most cordial greetings

    Your elby team
This sucks, I loved this program. I know I can allways find the latest copy, or go back to the 3.x series, but I was hoping for future development.

Anybody know how long this has been true? I never saw it in the news.

    I don't get it

Why is it illegal? Does it copy encrypted DVDs too? I mean, the MPAA sorta has a case with the DVD stuff (although there is an obvious collision between consumer fair use right to backup what they buy and companies not being permitted to "crack" DVD encryption - both of those can't be true).

But copying CDs? Oh, I see, CloneCD must help bypass CD copy protection schemes, for games and stuff, like the DVD copying software does for DVDs.

Still, just as p2p networks/software have valid legal uses, copying software does too. And I dunno, seems like it'd be bad to be able to prevent the public from making use of their fair use ability to make backups because CDs and DVDs *do* degrade. Then what? You gotta buy a new one, not because the technology isn't present to allow backups, but because they don't want to allow us to do it? That's, well, BS. I think they should have to provide us with indestructible media and/or free backups on-demand FIRST, then it wouldn't be so bad for us not to have the ability to make backups, because we wouldn't need them anyway.

I'm as much a supporter of protecting copyrights as anyone, but not at the expense of any of the fair use consumer rights. Consumer rights aren't all that powerful as it is, so every possible degradation of those rights should be fought tooth and nail. There are other ways to combat piracy than by screwing the consumers, and this kinda stuff seems to screw the honest consumers MORE than it screws anyone else.

I'm willing to bet that when the judges rule on this collision in the laws (illegality of violating copy protections versus consumer fair use right to back up what he has purchased), that the consumer wins. It's essentially the same thing as that ruling on p2p networks and their dual use nature - they can't be made illegal because they have valid legal uses, even though they are also used for illegal purposes.

    BTW

Good time to apply for a job at CloneCD. Antigua is fooking beautiful. I was stationed there for a bit in the Army, and it was incredible. Kinda like Hawaii or Jamaica, but better because not as expensive.

Nero seems to be up and running still. Surely if one had to go, then the other would as well?

its no big deal all the major p2p systems have clonecd available to easily download, i bagged a copy last night and it works fine.If anyone wats i can send them the ed2k hash for it or it is on kazaa , just search for clonecd 4 (of course make sure that you don't bag a copy that includes the serial number or crack as that would be illegal ;) )
