Resorting to legal strategies is precisely the opposite of what can get the industry going. Legal knives eviscerate not only the litigants, but also everyone else. A decision may profit the winner; in the long term it will cramp the ambitions of other companies which, fearing another suit, start hedging their bets.
Again, it's not a matter of right or wrong. It's just that an industry can't revive itself in a deep freeze produced by litigation.
Ultimately, lawsuits are not industry drivers; they're the brakes.
