Right click your mouse and "enter remote queue".

Are you having this problem on OpenNap? More than likely, the person that you're downloading from doesn't have a queue. It depends on the program they're using. I know I've had problems queueing from people running Audiognome.

When you're on the server see what type you're actually running on. You can do this by right clicking to get the server messages. The reason I say this is that not all "opennap" servers are the real OpenNap program. You have SlavaNap, which is most common, and possibly JNerve. Maybe the others aren't completely compatible with WinMX the way OpenNap is. I'm curious, if this is a problem with SlavaNap servers.

Here is what sourceforge says about Slavanap:
"Good client, but it ignores all standards and being blocked by some servers. Use any other client instead of WinMX"
    http://slavanap2.sourceforge.net/clients.php
