    Music 'pirates' sent ultimatum

    The recording industry is hitting back at copyright abuse
    Four internet users at the centre of a legal dispute over copyright violations have been sent 'cease-and-desist' letters to stop them offering downloadable music for free.
    The Recording Industry Association of America (RIAA), which represents musicians, said on Wednesday the names of four subscribers had been handed over by telecommunications company Verizon after a ruling by a US appeal court.

    Spokesman Jonathan Lamy of the RIAA , which represents musicians, said a fifth person was due to be sent a letter.

    The RIAA had previously said it had not yet decided how it would proceed against the four people, or if it would name them publicly.

    The association had sought the names of the subscribers under the 1998 Digital Millennium Copyright Act.

    The act allows music companies to force internet providers to hand over names of people suspected of large-scale music 'piracy'.

    On Tuesday, a US senator said he wanted to develop new technology which would remotely destroy the computers of people who illegally download music tracks.

    Senator Orrin Hatch, a Republican representing Utah, asked technology chiefs at a hearing in Washington about whether they could develop ways to damage or destroy the computers, though legal experts argued it would contravene anti-hacking laws.

    This is a bummer. I am sure more than five people that have Verizon download music. I thought that Verizon was going to fight this all the way to the Surpreme Court. IT seems to me just a matter of time before other ISP'S start doing the same thing, handing filesharesers names over. THey might have already. (Who Knows) This really sucks. I'm not going to stop file sharing. I don't download as much as I used to, but I still do down load music. It will be great when the all the file sharing programs Hide our IP addresses so they can't be traced and that they are set up to use the least amount of bandwith possible. EarthStation hides our IP's address. I wish Kazaalite K++, Imeshlite (or Clean Imesh)and the rest of them would redesign their programs to do the same thing.

    There is really no way concrete way to protect your ip address while your filesharing so dont be fooled by this statement.
    *EarthStation hides our IP's address* only if your using a proxy.

    I mean sure if you use a proxy then maybe. But remember when two computers are connected together directly their ip address will be shown but in this case the proxie ip address.

    Now everyone will not be able to use proxies for many different reasons. Remember that proxy servers may keep logs of users connecting to them. and who knows what they do with the logs. *cough*.
    so remember the only sure to protect yourself is to stop doing p2p filesharing. With regard to this fact hmm. *and whose going to stop filesharing* also a simple command used in ms dos prompt can reveal ip address.
    As well, if you have a firewall you can see all the current ip address connected to you as well.
    And I am not trying to single out earth station 5 but just because proxies are use remember that those people who work for the riaa, mpaa, etc also can obtain a local ip address from any internet provider.
    so really your not safe.
    proxies are good but not all of the time.
    proxies give you little bandwidth as well when u use them.


    any p2p program you use will reveal your ip address. even using freenet etc, your still going to have to connect to other computers to retrieve the data. HOwever with freenet expontentially there way of passing data is quite different from other p2p programs, but ip addresses will still be shown. *all dependent on the data transfered in such node as well as data passed between others. and i dont know to much but from what i read on p2p and for as long as i been doing p2p i can deduce this fact.. so you are more safe with freenet. but not safe enough.

    when people do p2p sharing there will be risks involve. no matter kind of protection you expect to use if you are doing public file sharing your not safe.
    now if your doing private hubs etc your safe to a certain degree because you are only sharing with trusted friends.
    that is where waste comes into affect.

    and I will make this clear i am not knocking es5 or any p2p program. I am going from experience and what I know.
    The simple bottom line any program that says that they can protect your ip address is simply lying to you.
    a true proxie can help you but then remember once again they keep logs of individuals connecting to the proxy.

    also if your using secure tunneling too you can be at risk, like i said all dependent on the trust of the proxy and many factors. peace

    I do believe that verizon is still waiting to septemember for another court appearance or a judgement to be read. I am not sure.
    But this is kind of interesting not only there are 4 individuals involved with getting letters now another person was added.

    hmm so it seems to me that how can they be sure that these are the 5 individuals.
    anyhows the battle is not lost. sure these people got these letters and stuff they will have to remove the mp3s they were sharing and will be warned. but i wonder what is going to become of this.

    I think that the precedent set by the riaa being given the power under the dmca to obtain personal information on and individiual is what the riaa was seeking in the first place. they sure made example for these individuals but not in the way u can expect.

    there names are mere names. the result of the precedent is what the riaa was after. so in the endlook at it this way your piracy will be invaded. the riaa accomplished what they wanted in the beginning.

    *a precedent*.
    when a precdent is giving this in fact allows the courst to take this ruling and using it in other cases. i mean this is how the judicial law works i think. *i am no lawyer* i am just posting my opinion and stuff. matter of fact I hardly do any p2p sharing anyway. but when i do p2p sharing i do it to share and such.

    anyhows My interest has gone into the something else. I just like reading about cases and such. Some of these cases may have no direct bearing on p2p but the idea that laws come into affect based on certain opinions expressions and such and falsified information is astonishing.
    I still say that this law *judgement* is not legal. but o well i am no dam judge and stuff.
    I just like to follow through will legal proceedings now. I mean I dont think this legal precedent should have been allowed.
    It will only allow any one to seek out peoples personal information at free will. this sucks as well.

    Just about anyone can say that someone is distributing copy right materials and that may not be the case but because of this new judgement peoples rights are going to be violated. And in turn peoples information can be giving out to just about anyone. hmm laws that are suspose to protect us are use against us. *citizens etc*

    They would have fought it to the Supreme Court but their appeals were turned down. Othe ISPs do not have a choice, much like Verizon didn't, I am amazed Verizon fought it as hard as they did and I give them a pat on the back for it. Hiding IP addresses in P2P programs will be a difficult (if not impossible) but fruitful task for any programmer, but don't get your hopes up. Obviously, in computers, what's impossible today is possible tomorrow. My idea of P2Ping these days is find someone on a network with a lot of files I want, PM them and get their screen name, and transfer files over my FTP later on. I have a lot of people that I share files with this way and together, we all have a little nitch and hookups and hook eachother up. Kind of like Waste, I haven't tried it, but I might if I hear enough good things about it.

    Orrin Hatch is just blowing smoke to get people to look at him (not that this idea isn't already in "development", courtesy of the RIAA), they will never be able to destroy someone's computer, I doubt it's possible, yet alone will it be legally allowed. All it will take is someone with deep pockets' computer to get hit, who has a legal leg to stand on, and this idea will be toast. And if it happens to me, worse comes to worse, I always have my files backed up on dozens of DVDs that I've burned. There's not much they can do to me, Windows Longhorn only takes about 10 minutes (if that) to reinstall, I'd welcome the opportunity. (I'll probably switch to it with the next beta release, after it's cracked, tweaked and hacked into submission, it's a pretty nice OS.)

    Overall, it sounds like the Verizon guy got off with a slap on the wrist after all. I mean, a cease and desist letter? Well, all they care about is that they won the case, at this point they can do whatever they want because in the future, they can just use this precedence.

    :( dam man there will be no movie made :)
    but i am sure this is the best recourse of action as although they did win the precedent and stuff at least these people will not have to pay and they are going to be warned.

    who knows maybe they will make a movie about this. but if they do they should consider the views of many people on both sides of the curtain of p2p filesharing.
    *file share users* as well *as *riaa* and p2p developers.
    sort of like a documentary and use these moneys obtained from the movie to pay off the riaa and mpaa.

    the truth of the matter no matter what the outcome of this judgement of law p2p will still exist and individuals will have to refrain from p2p or risk being caught. this time these individuals got off easy but next time who knows.

    like i said these individuals could make some money or something with the movie if everyone did exsist to pay back the riaa.
    so who knows.
