A hearing in the copyright infringement case of Internet file-swapping service Madster slated for Friday in Albany, N.Y., has been postponed until Jan. 15, Madster creator Johnny Deep said.

Madster had been granted a chance to make its case in a federal court in Albany, N.Y. earlier this month.

U.S. District Judge Lawrence Kahn of Albany granted a hearing on a motion to stay all proceedings in a U.S. federal court in Chicago, Deep said.

Last month, U.S. District Judge Marvin Aspen in Chicago ordered Madster to shut down immediately. The Recording Industry Association of America, among others, have sued Deep and Madster seeking to shut down the service which they say helps people infringe on copyrights.

Madster, formerly known as Aimster, allows people to swap files such as music using instant messaging software.

Deep and the two companies he founded, AbovePeer Inc. and BuddyUSA Inc., had to "immediately disable and disconnect any and all computers, including servers, used in connection with the Web site, server, hardware, software, or any other system or service owned or controlled by Aimster," according to Aspen's order.

Deep, representing himself, said he requested an emergency meeting with Kahn on the matter.

The case will be heard before Kahn on Jan. 15. Kahn has stayed all proceedings in Chicago until after that hearing. Deep called Kahn's order for a hearing a victory.

Deep said he was in the process of shutting down his service.

"I'm not distributing my software from my Web site," he said.

The RIAA would not comment on the upcoming hearing.
