SAN FRANCISCO - Manuel Villanueva realizes he has been getting a pretty good deal since he signed up for Netflix Inc.'s online DVD rental service 2 1/2 years ago, but he still feels shortchanged. That's because the $17.99 monthly fee that he pays to rent up to three DVDs at a time would amount to an even bigger bargain if the company didn't penalize him for returning his movies so quickly.

Netflix typically sends about 13 movies per month to Villanueva's home in Warren, Mich. — down from the 18 to 22 DVDs he once received before the company's automated system identified him as a heavy renter and began delaying his shipments to protect its profits.

The same Netflix formula also shoves Villanueva to the back of the line for the most-wanted DVDs, so the service can send those popular flicks to new subscribers and infrequent renters.

I knew this would happen or go down. But people insisted on using netflix or blockbuster. I signed up for two weeks, just to recieve 10 movies that i couldnt find on the net at that time. But my 20 dollar payment to usenet gets me 45 movies or more a month.

He pays for a 3 at a time deal, and thinks he should turn them around every day, i have no sympathy for this CHEAP asshole.

I've been with Netflix almost from the beginning, I've saved far more money with them than I could ever complain about in any cases of slowness.

Krell I see why you might say that but at the same time and correct me if I'm wrong but doesnt the service allow for unlimited rentals per the flat monthly fee? Unless I'm missing something i think this guy is right to call netflix on their touted "unlimited" rentals.

Everyone needs processing time, he must think they have unlimited migrant workers standing by conveyor belts just WAITING for his DVD to get scanned in, so they can make a mad dash to the post office to deliver his title before noon.

Im saying, he is absurd, and it is this kind of minority "stick it to the man" try to get more than what you pay for mentality that boggs this system down. In fact it bogs all of america down, in every respect.

He needs to work harder at his job at taco bell and bitch less about his pirating.

Nobody wants 20 dvds a month unless they are fucking wheelchair bound, or copying movies, get real.

What he is doing is SUEING a company so that he can further maximize his scant $18 . . this is why we have a class system, people like this make the bottem tier voluntarily.

Im lucky if I have time to watch 1 movie a month im even luckier if I can find 1 movie a month that I want to spend time watching.

This guy wants people to belive their are 22 movies a month that he just must watch :/

Id love them to raid his house.

To be honest, I only canceled my NetFlix (temporarily) because I've amassed so many unwatched movies that I just need time to catch up on 'em.

During my two weeks with netflix for the free trial. It took 15 minutes to rip the movie to my pc to compress and burn later.. I returned the movies the same day. I only had the chance to get 10 free ones in the two week period. I also did the same with blockbuster. 20 free movies.. Most were things that hasnt been posted for me to download or rare favorites.

I just counted the movies I have returned, which is about 254 in a 14 month period of time . . . and im SLOW to send them back!

I will let them use my account for voracity, and post on craiglsist for anyone that knows if this guy copies movies or not.

he may not be a pirate, because if he has a family like mine, we can each get a movie (me, kids, parents) and all watch them the same day and return them. it turns into a movie per person per 3 days. this isnt even close to being an obvious pirate, even though it is consuming the same amount of DVDs that this guy is. the story is too vauge to tell for sure if he has a familiy like mine.

Ive been with Netflix almost from the start, and I AM SAYING that given postal holidays, dropping mail in after the post office has picked up for the day, weekends, solar flares, and whetever the fuck else might cause delays, like NOT turning movies around as fast as HE could have . . he doesnt have any real basis for a LAWSUIT.

I just prefer a little more fact based substance then a mere posting and a internet story before I start thinking someone is a fucktard, pirate, theif, or whatever you wish to lable someone.

What in the hell is it with you when someone complains about paid service, quality, quantity, etc. you start labeling him/her, some kind of loathsome derilic. What about the company that might be fucking with him, violating the agreement? What about if they are sticking it to him?
Again I have no real idea of what the company or the user agreed to but, if there is any validity to the fact that the company is slowing his returns down so he can have just so many a month, then they are, as you put it fucktards. And a bunch of greedy SOB's at that.

Isnt it a more plausible explanation, that when movies come in to the Netflix warehouse from the USPS, that not every movie that shows up gets scanned in THE SAME calendar day? Can you imagine the rows and rows of rolling bins filled with thousands and thousands of those red envelopes? These have to be processed in, and new orders processed out.

Then there's the matter of people who give their DVDs to their kids and their dogs, which are pretty much the same thing as far as I can tell. Netflix has to account for this loss and clean\resurface titles which also reduces availability.

All things considered, an 18 movie turnaround is pretty damned good on a 3 at a time contract! I have that average and I dont even try.

If he doesnt like the quality or frequency, fucking QUIT, cancel and go to Blockbuster, which i can tell you does NOT have as quick turnaround time as Netflix.

Again, I can speak on this because I have a long firsthand knowledge and experience with it, not throwing an opinion out there because I need some kinda validation from you.

This doesnt equate to "throttling" it equates to building a business where new customers are not penalized by people trying to beat the system. I get new releases the day they come out, period.

I only rent unlimited 1 movie at a time for $10 a month, but I average 2 a week (8 movies a month). So, that's about 1 every 3 days! I figured that's 1 day to mail to me, 1 day to mail it back to them & 1 day for them to process (forwarding & return). All that including postages, seems fair to me. :icon_thum

If i go to a resturant, and dont like the service. I dont sue them or hold the managers and big company at fault. I take my business elsewhere. I know netflix makes its money on the people who keep their movies a week or dont return them as fast or people who pass them out to other friends. They do get the few people that return them the same day and recieve more the next day. They do have competition and as well as us filesharers to watch their bottom line. We do have a system on hand at the torrent sites.. PEOPLE WHO LEEch and dont share, get waiting times. I'm pretty sure he copies the movies and burns them to watch later. And probably just keeps so many on the queue list that they keep sending them out.. They dont gurantee 1 day deliver, they always said there next day delivery is at 89-95 percent. They dont process movie titles on the weekend, so monday comes and there sending thousands.

TO KEEP new customers, and from going to other online services. They may need to send the popular movies to new customers or they would cancel their account. I could think of a few companies to sue before ever netflix. PEPSI for not having a corrosive sign on their product, DVD-r' manufacuring plants that may make dvdr disc that have the life span of 2 years if lucky. City of Dallas as well as social services for being racist against white women. My mom getting child support from my dad which was 360 a month, and welfare cut her food stamps down to 80 a month for two kids.. Making her show documentation every few months about her disability (Blood disorder, made her retain water in her body and she had to be in hospital every 2-4 weeks to get drained) and hospital visits and send her stuff out to her to let her know she has to look for a job or make job interviews. Even though she goes in frequently to show them she cant work, and not able to own a home in her own name. Her sister had to have it in her name and show her as a renter.
KAISER HMO for not disclosing my moms sickness and sending her to other doctors that work with kaizer to conceal her illness and not disclose it so they can treat her. President Bush for wasting all the oil/gas to send troops, soldiers to iraq, vehical supplies and army supplies, deficit to the country. Sue pharmacy companies for making more side effects then the mild pain they get rid of. Sue the world for just not having a disclaimer that reads, "This life may be hell and we will tax the hell out you for as long as the doctors can keep you alive, and well make it a law that they cant discontinue your life even if your quality of life shall go down.

I think the guy has the right to complain about poor service if he's paying for it,hell I would!

As for people not being able to watch 20 movies a month,that's bull crap,I rent (and watch) a hell of a lot more than that,and I'm not wheelchair bound.I do burn them after,but I do watch them first.

P.S. Even when I didn't burn movies I still rented heavily,but I am a big movie buff.

I just confirmed something Ive suspected a while.

When you have movies in your queue, and they are NOT available at that particular shipping time at your usual distrobution center, Netflix re routes the movie from the next closest center with the movie.

The problem with this is at least two-fold

1) By the time the movie gets to you via the longer route, it would\may have been available locally anyway

2) What they SHOULD do, is make an option to only get movies from the CLOSEST distro center based on THAT centers avialability.

If movies 1 - 4 are available, but not #5 and 6, then you get 7 and 8 and the queue remanaged.

I'm the Manuel in the AP article with feedback on this discussion. Krell said I'm being unreasonable concerning Netflix's processing times. There are several web sites that calculate the number of rentals possible per month from Netflix including TallRock (http://www.tallrock.net/RentalSim/index.html) and FrogCircus (http://netflix.frogcircus.org/). They demonstrate it's possible to receive more rentals than Netflix sends me. Krell also argues I copy my rentals--I don't. On average, I rent 36.5 rentals from 3 online rental services. I don't watch TV, instead I watch my rentals. Krell has also mistaken me for Frank Chavez who has sued Netflix.

I did have netflix for a few months ans then I cancelled they promisse you unlimited amount of movies, I sent the movies back in my city on tuesday, and theys end me new movies on monday, give me a break that is stupid, they are the idiots.
I prefer to rent in hollywood video, it is cheaper, and I pay as I go.
If you promisse one thing, please deliver or else.
I hope that they will go out of business. Shame on them
