View Full Version : IPod User Sues Over Potential Hearing Loss

An iPod owner in Louisiana has filed a lawsuit against Apple Computer, alleging that its iPod music player has the potential to cause hearing loss.
Filed by Seattle law firm Hagens Berman Sobol Shapiro, the proposed nationwide class-action suit could include more consumers in the future and cover the breadth of the iPod line.
The suit alleges that iPods are designed defectively and do not provide sufficient warning against possible hearing loss, even though the company includes a warning with each iPod, cautioning that hearing loss might occur if earphones or headphones are used at high volume.

Yada yada yada, there is always someone trying to make a buck out of possible stupidity. You can ruin your hearing using an old Sony walkman also. What about all the stereos in cars that are so powerful? Now there is a really good chance to make some bucks.

its common sence,dnt turn it up so high,why doesnt no one sue cell phone comp. u can get brain cancer! or pc monitor creators u can get some sort of cancer, .....thank u ....

Ok guys, how about we launch a lawsuit that has a chance? Lets get together, and sue the zipper manufacturers, as Im willing to bet that most of us know how damn dangerous those things can be. That is an obvious design flaw that has been allowed to continue too many years, causing untold pain and suffering.

I will admit to having a fashionation with the nursing ones. Probably goes back to my childhood. All kidding aside, fashon designers, by and large should be shot, or at very least sued, going by the present criteria. Some of the footwear causes enough damage to also be worthy of starting a lawsuit.

I already figured you for one of the smart ones, and Im waiting to hear the complaining from those that jumped on the line dancing bandwagon, and wore those god awful cowboy boots. I know what they actually feel like, as I had to wear them when riding during reining competitions.

Too true, I got stuck with the wifes horse, after she was injured in a fall. So I started doing some reading on using how to control a horse using your seat ( butt ). After some very serious study, I figured WTF, Im going to see what the old nag could do. I took him to a lope, heading to the gate, lifted the reins, and sat deep in the saddle, and he did the sweetest sliding stop you ever saw. Turns out that he was a well trained show horse that went ring sour from too much competition. He was a real blast to ride, and could do spins, and turn on the forehand on command. Show him a show ring, and he got pissed real fast, so we spent most of our time just trail riding.

Although the grounds of the lawsuit may be rather specious lawsuits like this help consumers. Although it is "common knowledge" that they do cause hearing loss regardless of the outcome of this lawsuit future IPODS will most likely come equipped with a sound modifier so that it can only output a certain decibel of sound which is safe to the consumer. By doing this unknowing consumers will be protected and hearing loss may hopefully become limited.

You know how much police officers suck when they try to NAB you for speeding with their radar gun as they are hiding or have set up a speed trap... Knowing it may cause colon cancer since they sometimes prop it between their legs or near their body.. Sends chills down my spine. =)

no... they will just have a stupid sticker like the "Don't Steal Music" joke on there.
It will say "Don't play music too loud, can cause hearing loss"
this is just like the McDonalds women who sued to make a quick buck because she like a moron went over a speed bum right out of a drive through with a coffee between here legs and got burned. She won because the cup did not say "Caution: Hot"

I love how people sue companies for what should be common sense. I don't know why the legal system actually takes these cases seriously. Really, if you buy coffee, common sense should tell you that it is hot, because it didn't say Ice coffee on the menu board. If you buy a device to play music and the ear buds go pretty near your ear drums...common sense will tell you that if you play music too loud, it will damage your hearing.

Actually the companies that sell the loud stereo's and whatnot, have a disclaime that their items can cause hearing loss if played at a certain decible and at certaIn decibles you can die...supposedly on the dieing part.
The one thing people haven't tried is that their car is the one that caused them to speed...that is going to be the next lawsuit...
