This is a reported iPod bug and the common fix is to reset it. With this 40Gb, 4th generation model you flip the hold button to on and back to off. Following that you push and hold play and menu buttons simultaneously... and pray.

Maybe that'll help a little?

I work at Best Buy and all I can say is I hope you bought some kind of service plan for your iPod. It seems like something is always going wrong with the iPods. I know I had the iPod mini and mine broke too. But I work at Best Buy so I got a discount on the service plan :-) Just brought it back and exchanged it for the Nano.
Anyways, the service plan is always worth it on iPods because Best Buy will replace the battery under your service plan and those batteries don't last that long. So if you got a service plan I'd bring it back to wherever you got it from.
If you didn't get one, well then I guess it's something to think about on your next iPod purchase.

CrashPeer, that's the least productive comment in a help thread I've seen in a while.

My experience with harddrive players hasnt been all that good. I would recommend waiting a while before buying them sine the batteries are all crap. That my opinion anyway.

don't waste your money on a service plan
buy a new one, and return the old one in the new one's box with the new one's reciept
works great for printer cartridges too

I was thinking of doing that to get a video instead of my shitty photo ipod, just do the switcheroo at some place.
I think I'll change your statement to... Don't waste your money on a service plan that you have to pay for. If you have a credit card that is worth anything, it'll automatically give you an additional year of protection on anything you buy, and you should take advantage of it.
I have Amex Blue for Students and it not only "doubles" the manufacturers warranty for up to an additional year, but it gives 90 days of accident, theft, and loss protection to all products I buy.

Are you playing video all the time. Video playback I think, cuts down the battery time considerably.

So the solution might be to just switch HOLD ON and then OFF again, without touching the wheel in the process

it isn't free. you bought it. if you have no other recourse and a defective product, you do what you have too
p.s. there is no serial # on the packaging, only a upc#, which is always identical

There is a serial number on the iPod itself if not on the box. And if you use a credit card to purchase the product that you swapped out, I'm sure it can be traced to you. If you paid cash for it, I think they give you refunds with a check only for orders over $50 dollars; which means you need to give them your name and address.
They come with a one year warranty. If its still under warranty you can just walk into the Apple store and get a replacement(if they cant fix it right there), or at least you could before(I did).

don't register your products, or sign up for warranties, and there is no way to connect a product to you (it also prevents piles of junk mail)
a credit card reciept doesn't have a serial number on it, it has a upc#, same as the box

I buy protection plans, mainy because dealing with the manufacturer can be difficult and doesn't always produce results.
Also, when a newer, better model of the product replaces the one I have... it's so easy to trade up.
Not to stoke a debate, but I don't think the iPod is overrated. I think what the oh so eloquent poster was trying to say was, "I can't afford one. Therefore it sucks."
