A Chicago man who bought Microsoft Corp.'s new Xbox 360 has sued the world's largest software maker, saying the new video game console has a design flaw that causes it to overheat and freeze up.

The proposed class action claims that in Microsoft's bid to gain share in the $25 billion global video game market, the company was so intent on releasing the Xbox 360 before competing next-generation machines from Sony Corp (NYSE:SNE - news). and Nintendo Co Ltd. that it sold a "defectively designed" product.

Robert Byers, who brought the suit, said the power supply and central processing unit in the Xbox 360 overheat, affecting heat-sensitive chips and causing the console to lock up.

Microsoft spokeswoman Molly O'Donnell on Monday said the company does not comment on pending litigation.

Complaints about the problem surfaced quickly on gaming enthusiast Web sites after the Xbox 360 debuted on November 22.

Console owners reported that some systems had crashed during regular use as well as during online game play using the Xbox Live service. Problems included screens going black and the appearance of a variety of error messages.

At the time O'Donnell told Reuters: "We have received a few isolated reports of consoles not working as expected."

She declined to say how many reports Microsoft had received and said that calls reporting the issue to the company represented a "very, very small fraction" of units sold.

The lawsuit, filed on Friday in federal court in Illinois, seeks unspecified damages and litigation-related expenses, as well as the replacement or recall of Xbox 360 game consoles.





It just figures that someone out there just has to try and sue for money! I wouldn't doubt if all he gets back in the purchase price and maybe a free game!

thanks for the article axlman! As far as money goes you are most likely correct... barring any damage to personal property (other than the 360 console) by the overheating issue the most the claimants will be entitled to is the cost of the console plus whatever they can prove that the time lost in recouping their investment is worth.

A class action lawsuit is about holding a corporation responsible for its actions or negligence, etc. first and foremost. Secondary is monetary reward.

In the future, please include a link back to the full length article when posting news. It is important what with copyright and all that. :-)

i hope micorsoft gets sued. then, i hope they are forced into a very costly recall, upon which they're already losing money per console made, and hopefully, plummenting confidence in their system. fuck you bill, fuck you.

This is pretty funny since in my local game shop they had this exact problem, first of the console said "System Error, Please cotact Microsoft..." something like that, we pushed the reset button and the screen just went black ...

Maybe Jau_Peacecraft bought one, I would too if I got one.

Nowdays, Microsoft rush their products & software out to impress wall street. Consumers are no longer the top of the list of considerations for their bottomline profits report but business customers & wall street brokers!

This is just amazing to me. How do you not catch problems like this M$? I hear its not very widespread but thats from M$ and then I also hear its fairly widespread (10-15 percent) from various sites which I dont trust anymore than M$. I'm guessing its a very loud and pissed off 5 maybe 10 percent tops ( I hope) thats causing the hoopla. I know launching a new system can have its problems, first gen systems are always the buggiest and I know ps2 had alot of problems with defective hardware but it didnt seem this bad. I really was hoping 360 would turn out well just to keep sony on their toes and making the best possible hardware/software ect. Competition is always a good thing.

Another dumbass lawsuit.. I mean if it doesnt create some harm or could be harmful, they have no case.. you know how many recalls on cars and other merchandise people go through.. And buying pc's that have faulty motherboards.. Its just a ploy for them to get money since they wasted so much money and time getting a xbox 360.. No game console is worth that much and especially the first release where there is gonna be bugs and glitches.. They are just worst then microsoft.. money hungry.

when a system first comes out it is bound to have problems honestly i didnt expect Microsoft to have this problem with the 360 for the fact of how long they have been in the industry and how well the xbox performs. i guess ill hold off on buying one for a while just to see how this works out. bring on the PS3!!!!

I feel like the only guy who still likes nintendo on these boards. They usually have little to no problems with their hardware and they have fun games in my opinion. I guess to each their own.

A big part would fall on IBM's shoulders as they used some type of new testing on the CPU's to speed up the development time. Im sure there was a thread about this here some time ago. I guess no one reads them.

I predicted this about about two weeks ago, and personally ripped apart a xbox 360. The case has merit.

also we never needed microsoft, in fact I think we'd be a helluva lot better off without them. Xerox gave apple the OS in turn gave microsoft the OS which they basically stole modified and now we have a company who has a global monopoly in the marketplace. This isnt good for a whole slew of reasons. The problem is this lawsuit wont really hurt them at all. The best would be another incident of ripping off a browser like they did with Netscape or another REAL player incident. Funny how every year someones complaining about there property being infringed upon by Microsoft! This is not an honorable company whasoever and i personally take great pleasure in anything that hurts them.
