Late last month, Michael Brown received notice that the recording industry was suing him in federal court for allegedly trading copyrighted music illegally on the Internet.
Brown, 56, sitting on his front porch in Clifton, says he didn't do it. And for good reason.
"I can't understand someone sitting 2 feet from me," much less listen to music, said Brown, who describes himself as almost deaf.
After he was served with court papers, Brown's 17-year-old daughter tearfully informed him she had shared the 889 files cited in the lawsuit with Internet users around the world, he said.
Now Brown faces a choice. Pay thousands of dollars for a lawyer to fight the charges. Or pay thousands of dollars to settle with the recording industry.
The self-employed engraver, who said he earned $13,410 from his business last year, can't afford either.
But that hasn't stopped record companies from seeking his money.
The Recording Industry Association of America, on behalf of several large record labels, has filed thousands of lawsuits in the past year against alleged file sharers for copyright infringement. At least 11 Kentuckians, including Brown, have been sued in U.S. District Court in Louisville since last year.

so what happens when you cant pay like that? do they forward you to collections?

besides, he cant be held responsible from his daughter's actions, and she is a minor and you cant sue a minor.

I really wonder what would happen if someone like him simply says "I can't afford to pay anything, put me in jail if you have to". Would they actually do it?

no i do not think im right, im just saying whats going in my head over this situation and every simular situation out there. i figured that i would say somthing more interesting than "that isnt fair" and get a dumb responce like "life isnt fair, live with it douche-bag!"

frankly, i dont care if im right or wrong. hell, i dont care if pirating from tyrants is right or wrong; i just do it. we live in a fucked country, and some one, no matter how dumb or retarded they sound, should at least have enough balls to say what they think things should be like.

I wonder how long he would have to go to jail if he didn't own anything in his name to sell? Like, if he was unemployed, was renting, and didn't have anything that came to over $500.00 in total. Would he have to go to jail for life or would being in jail give him so many credits per day for being there?

Perhaps he is correct. In certain instances he could not be held liable. It mostly rests with the question of permission and/or knowledge of the daughter's actions.

In the same way public libraries and such are not liable for internet users actions even though they have the IP account in their name.

There have been many instances of people getting off of these charges by alleging wardrivers illegally accessed their wi-fi or in one case tapped their telephone line. Of course the RIAA does not publicise these "losses." Most people are too scared to fight these Nazis and just settle without going to court even when they could win. Sometimes they just don't want bad publicity too.

Point taken. But if you want to achieve useful outcomes for yourself, or if you want to contribute towards those outcomes, you need clear, unambiguous communications skills and astute judgement about when to say what and how others will understand it and react to it.

his girl would probably go to juvenile hall or prison (if tried as an adult) and he may get tagged with negligence...parents are usually responsible

yah, i know. but would he be charged with murder? this guy is getting charged with file shareing, even though his daughter is the one who did it.
