What if you use a semi decentralized setup like eDonkey where clients offer their content to the servers. All requesting parties do a search request to the servers and the server acts like a directory.
Now make sure the servers are in countries which have bureaucracy as a sport or just hate america like Iran, North Korea or something. This way the servers hosting names of content are impervious to lawsuits and lawsuits are just too costly. I'd like to see the RIAA trying to get their ISP info. But then again the servers only have names and no material itself.
When you request content over an encrypted line and download it over an encrypted line all records in America or Europe are just data and not copyrighted material (They can't prove it).
This way nobody sees your requests or incomming traffic which means your download itself is safe.
The RIAA can for example do a search on content and find the big players and sue them. They define 800songs as illegal and lawsuitable i heard. This can be countered by only supplying a sourceID as the holder of the data which can be translated to an IP on request. All IDs are unique even if their data holder is (server side table). This will make you have to request the IP per source from the server which is ok for clients. This is to stir the shit up and make an RIAA scan the server 1 source at a time until they have enough info on one big player. This should be highly filterable.
Another idea might be to provide a password message which selects a random password for entry of lets say 4 letters to read the content of the server or to get the data from another peer. This way every transaction is an easy hack and if the RIAA pulls out a lawsuit you can say they hacked you and their claim is unlawful and sue them for unlawful entry :-).
If all else fails we can always build a P2P-wifi network but somehow i think it will soon become illegal :-P
