I stopped wondering about that one a long time ago...just when I think I have a grasp on the present, stuff goes crazy. I've decided just to go about my business and grab some popcorn watch everything unravel

The RIAA has already won to some degree. But then again so has P2P. Each side has achieved what they want. The RIAA is selling more CDs and they have their legit music distro going strong. The pirates have a new technology to distribute thier warez. So in the end everyone came out ahead...While P2P will never bring down the music industry, consider being able to download your favorite song for free a small victory...

As I posted on the news thread about 750 getting sued..

CD sales have increased at the same time as P2P has increased which shows there is no definite link between loss of profits and the increase of users on the p2p networks. - Which is what we're getting sued for.

In other words.. their reasons for sueing are defied by a combination of their own admission of increased sales despite additional recent research into p2p usage on large residential networks. (The RIAA have lied, p2p traffic has increased NOT decreased.. see here (http://p2pnet.net/index.php?page=reply&story=2832) - p2pnet.net)

In addition to that, most people share to (or below) a 1:1 ratio. Irrelevant of the actions of others, you should only be responsible for 'distributing' the equivalent to ONE copy of each file you are caught with. The amount of 'Distributed' content ('units' of 'product') is grossly out of proportion to the excessive sums demanded in settlement by the greedy bastards at the RIAA. And these lawsuits are usually over media that is widely available even without the presence of the parties being sued.

I'm not saying we shouldn't pay for the units of product we've illegally distributed. We should (if we get caught!!) :;)

But we shouldn't have to pay more than the RIAAs/courts/lawyers administration fees and a sum of money equivalent to the 'units' of 'product' we have personally distributed (which to my knowledge... has NEVER been proved in an RIAA lawsuit) - Demanding more when they don't even know how much you've distributed and don't have proof... is just disgusting.

notbob's right... they only get away with it because money buys power. personally I'd try to fight it, but that's only because I know technical loopholes that will make me potentially innocent and I can clearly demonstrate the unfairness of the suit even if I had been guilty. Most people can't though.. and buckle under the pressure of the lawsuits... opting for a more affordable out of court settlement :(
