question
has anyone thats ever been sued by the RIAA, taken them to court instead of settling out of court. Someone has to do it

one did - but eventually gave up. nycfashiongirl. There are a lot of unsettled suits out there - my bet is that someone might try, but is working on an angle... it's a pickle to try and talk you're way out of...

MPAA and software are only sending out cease and decist letters now. There is no danger for prosecution.... yet. You may be in danger though if you receive multiple C&Ds, then your ISP will say you are violating policy, and cut you off. But if you live in a larger metro area just switch ISPs, they'll be glad to have your business.
For safe music sharing try private DC hubs, newsgroups, or even try www.allofmp3.com (http://www.allofmp3.com) for super cheap quasi-legal full albums in good quality, even music videos, and there's zero chance you could get sued for that. www.espew.com (http://www.espew.com) gives free shit out too butit's only a matter of time till they're gone. But the RIAA can't see who dl'ing from there...
