I've just recive3d a takedown notice From Vivendii regarding a file i downloaded with bittorent a while back. i deleted the file ages ago anyways. My Isp just forwarded the takedown notice to me but didn't say anything else they didn't write please contact us regarding this issue or anything however vivendi have given me an id number and wrote "we urge you to take immediate action to stop this infiging activity and inform us of the results of your actions. we appreciate your efforts towards this common goal."
Should i contact them? i assume not since it is my isp that is my provider of connectivity and since they just forwarded the email without even asking me to contact them they probbley arn't so bothered...
Plus i live in the uk, what would happen if i don't respond to vivendi? would they contact my isp again?

First of all, do not reply directly to Vivendi Universal.
There's a reason the notice was forwarded to you, rather than sent directly, and it's the same reason it included a case ID number: Vivendi Universal do not know who you are. They may (or, more likely in my opinion) may not proceed further once they have your email address, but I'm sure you'll agree that you'd rather they didn't have it.

I am familar only with U.S. copyright infringement procedures, and have no knowledge of what may portend for you in the UK. If the process is similar in your country, I would suggest -- and suggest only, mind you -- that you contact your ISP and politely state that the forwarded letter was obviously sent in error, that you have performed a thorough vetting of your HD, and that no such file exists.

That response to your ISP is all (again, using U.S. rules) your ISP needs to send a "material removed/never existed" response to Vivendi Universal, which will then clear your IP from its mailing campaign. Otherwise, yes, they will keep writing to your ISP, which enjoys sending out these notices only slightly less than you enjoy receiving them.

ANYHING YOU SAY CAN AND WILL BE USED AGAINST YOU AT ANY TIME!!!!!!

SO...ignore all inqueries, run the other way, give false/missleading info and ID, dont cooperate, kick and scream if they grab you, etc, etc.

If you are a sheep, then they will gladely lead you to be slaughtered.
If you are a mad dog that they cant get a good hold of, they will move on to easier prey.

This is a fact of life that applies anywhere in the world.

Could you please give a link to the actual page(s) with the "What to do" information? I've searched the EFF's site for the last ten minutes and I'm not having any luck at all finding anything.

Hi,
I need your help, I just received a letter from MPAA, saying i downloaded one movie, and they havent taken action yet, however I m an international student, and I'm graduating and leaving the US in one month and not coming back, is they file anything or not, can this effect my leaving the country? (you know to follow the lawsuit or they wont let me leave blah blah? )
Or it doesnt effect anything, and i should ignore even there would be a court date before i leave, or after.

Please let me know, thanks

Did it say there were taking legal action or if they were just warning you?

If they're taking legal action, you might consult a lawyer as even a civil lawsuit I believe may keep you from leaving.

If it's a warning, as Mels said... get the hell out of our fucked up country and appreciate that you were not born, or live here permaneantly :)

Well if you live in the country that just reelected Bush you have a problems that you are just going to have to learn to deal with things.
The "Land Of The Free" had some great ideas behind it. To bad it has come to a horrible situation such as this.
America got fat for years . But it didn't last.And after Bush and his handlers get done,2008 is just a far away dot on the horizon.The damage that will be inflicted in the next 4 years will never be overcome under this 1 party system.(1) (ONE)

Hey, it said on the notice, they havent taken action yet, but then again it says you might expect something from the copyright company. even if they set a date, i dont think it would be a problem, coz i have a right not to show up at the court i guess, even if its a civil lawsuit, then leave

What country would you be heading back to? If you were ordered to appear in court, and then skipped the country, that would be a pretty big crime, but only would you maybe get in trouble if you were in a very friendly country (Britian for example) but still I doubt you would get in trouble. If you were heading back to a country such as Mexico, don't even think twice. But if it said they weren't taking action yet, that usually means to just stop sharing the file, at least until you get back home. :)

My advice is to show-up at court and deny everything. Dont give any ground, hire a lawyer or have a public defender represent you(errrrrrrforget the public defender) The US court system is founded on delays and continuences.......that's just the way its done the longer you can delay a ruling the better off you are.

If you choose to represent yourself have a carefully planned script, that you will follow to the letter, you deff need legal advice to do this. Civil courts are far different then criminal
courts, even if a a ruling went against you, you dont have to pay because in the end you can always declare bankruptcy and no one can touch you.

Your best Defence is to delay delay delay. Dont even consider talking to them about settling thcase either, as soon as you enter mediation talks that points to your guilt.


btw: Good Luck! and if you ever plan on coming back to the US you better show-up in court :;)

Yes, yes, YES! That's what I keep telling people.

It's the "I dunno.. no I didn't." defense. Then you counter sue for invasion of privacy, harrasment, and racketering.
