SBC companies acknowledge that legitimate copyright owners should be allowed to protect their rights. However, we also believe there are serious flaws in the current application of the Digital Millennium Copyright Act (DMCA) subpoena power that clearly threatens the privacy rights and safety of our customers. Endangering the security, and invading the privacy of all Internet users is neither an effective nor proper means to protect intellectual property interests on the Internet.

The DMCA subpoena process is truly rubber stamp. Anyone claiming an interest in copyright need only file a "good faith" statement of copyright infringement with the clerk of the court. There is no judicial oversight prior to the issuance of the subpoena, the accuser never has to appear in court and never has to explain what he/she does with your private information. These flaws allow anyone to seek personal information on any Internet user without the usual safeguards associated with other types of subpoenas.

Didn't you say "they're" is instead of "their" yesterday Ken? I remember it made a funny sentence.
I'm not perfect, but I didn't complain.
Actually I don't think is was you. I wish I remember what the sentence read now...

thanks for the link man..sadly enough I didnt know that it was that easy to get information about you from you're ISP hmmm gets me thinking!

You know what would be cool? It would be cool if someone started to use this law to get personal information on RIAA types, then published it on the web. You know, like if you know Hilary Rosen's ISP, use the DMCA to get her home address and all existing IP numbers. Publish the info on a spoofed website.

I wrote my Congresswomen, making sure to mention how identity thieves, internet stalkers, and sexual predators could use subpoenas to get personal information about potential victims: fearmongering for a good cause.
