sharing & the riaaa

Friends,a simple question: if 'sharing' is turned off on Beaeshare,can the RIAA still track you?

The answer to your question is yes. However the bigger question of "does it matter?" is no.

It is concivable for the riaa to host a pirated song on the bear share network and then log your ip if you download it.

They however probably could not prosecute you for this because they are oppenly offering a file that they have rights to thus making it a legal transaction.

Also it is concivable that the fact that when you are downloading a file you are constantly requesting more sources for it. The RIAA could use those searches for more searches to notice that you are downloading the song.

None of this is important though because the RIAA is prosecuting those who share not those who download.

For the RIAA to prosecute you for downloading music from fasttrack would be the equivilant of prosecuting someone who accepts a cd from a stranger on the street without checking to see if they were authorized to give out the cd.

Bearshare doesn't use FastTrack thank goodness. They can't sue you if sharing is turned off, that's what they want you to do, they want to slowly kill the networks so they will be like Winmx. This will effectively stop the networks, where they will never be able to sue everyone. And it makes it easier for them to sue the few people who are sharing lots of files over fast connections.

If you are living in the US and are really worried about it, just don't share more than 50 files or so and they will pass over you. I think as long as most of the music and stuff you have isn't highly demanded they won't even find you.

Its good not to give people a false sense of security, Ive read in recent ZP news posts of people being nabbed by the RIAA for sharing as few as 8 files

yep... that's pretty much how it works... otherwise, all p2p networks would be screwed up. all the riaa can do is host a song of the same length and time and what not, but with static, pops, or just missing pieces. and they do that now anyway.
