View Full Version : Back royalties from Webcasters?

Am I correct in thinking that Webcasters, even those who have already flipped the switch, are still on the hook to pay back royalties at CARP rates they can't afford for the last 3.5 years (since the DMCA went into effect)?

I shudder to think what will happen when the RIAA and its legal team try to collect $100K or more from some poor ex-webcaster whose total revenues over that time period never came close to that amount, and most of what revenues they had have already been used to cover operating expenses.

Yes indeed you are correct about back fees. Most webcasting networks like SomaFM one of the more popular ones shut down due to this matter. Most are just declaring bankruptcy and under Chapter 9 protection. I still think that this is again stupid for the RIAA because web radio was a great way to zero in on a paticular audience and genre. I wonder though if businesses that did webcasting radio services can rename their enterprise and start back playing again if they have filed Bankruptcy. Anyone know?
